This Privacy Policy describes how Youth Crews, Inc. (the "Site", "we", "us", or "our") collects, uses, and discloses your personal information or personally identifiable information (as those and similar terms are defined by applicable data privacy laws, and collectively, "Personal Information") when you visit, use our services, or make a purchase from youthcrews.com (the "Site") or otherwise communicate with us regarding the Site (collectively, the "Services"). For purposes of this Privacy Policy, "you" and "your" means you as the user of the Services, whether you are a customer, website visitor, vendor, customer, merchant, or another individual whose information we have collected pursuant to this Privacy Policy. Capitalized terms used but not defined herein shall have the meaning set forth in our Terms of Service or applicable data privacy statutes, as applicable.

To provide the Services, we collect and have collected over the past 12 months Personal Information about you from a variety of sources, as set out below. The information that we collect and use varies depending on how you interact with us.

Full credit card information is not available to us.
  • When you visit our Site, open or click on emails that we send you, or interact with our Services or advertisements, we, or third parties we work with, may automatically collect certain information using online tracking technologies such as pixels, web beacons, software developer kits, third-party libraries, and cookies.

7. How We Use Your Personal Information

  • Providing Products and Services. We use your Personal Information to provide you with the Services in order to perform our contract with you, including (via us or a third party) to process your payments, fulfill your orders, to send notifications to you related to your account, purchases, returns, exchanges or other transactions, to create, maintain and otherwise manage your account, to arrange for shipping, facilitate any returns and exchanges and other features and functionalities related to your account. We may also enhance your shopping experience by enabling Shopify to match your account with other Shopify services that you may choose to use. As more specifically set forth in Section 10 herein and by Shopify, Shopify will process your Personal Information as set forth in the Shopify Privacy Policy and Shopify Consumer Privacy Policy, and other Shopify terms, as specified by Shopify.
  • Marketing and Advertising. We may use your Personal Information for marketing and promotional purposes, such as to send marketing, advertising and promotional communications by email, text message or postal mail, and to show you advertisements for products or Services. This may include using your Personal Information to better tailor the Services and advertising on our Site and other websites.
  • Security and Fraud Prevention. We use your Personal Information to detect, investigate or take action regarding possible fraudulent, illegal or malicious activity. If you choose to use the Services and register an account, you are responsible for keeping your account credentials safe. We highly recommend that you do not share your username, password, or other access details with anyone else. If you believe your account has been compromised, please contact us immediately.
  • Communicating with You and Service Improvement. We use your Personal Information to provide you with customer support and improve our Services. We use Cookies to power and improve our Site and our Services (including to remember your actions and preferences), to run analytics and better understand user interaction with the Services (in our legitimate interests to administer, improve and optimize the Services). We may also permit third parties and services providers to use Cookies on our Site to better tailor the services, products and advertising on our Site and other websites.

Please keep in mind that removing or blocking Cookies can negatively impact your user experience and may cause some of the Services, including certain features and general functionality, to work incorrectly or no longer be available.

If you notify us of your preference through GPC, we will treat such signal as a valid request to opt out of sharing / targeted advertising for the associated browser or device, and, if we are able to associate the device sending the signal to a Shopify account, we will apply the opt out request to the account as well.   • With vendors or other third parties who perform services on our behalf (e.g., IT management, payment processing, data analytics, customer support, cloud storage, order fulfillment, and shipping).

We do not use or disclose Sensitive Personal Information, and you agree not to provide us with the same.

10. Third Party Websites and Links

Our Site may provide links to websites or other online platforms operated by third parties. If you follow links to sites not affiliated or controlled by us, you should review their privacy and security policies and other terms and conditions, some of which may be materially different than our site and some of which may collect or process Sensitive Personal Information or otherwise address Personal information in a manner which is materially different than how we manage Personal Information. We do not guarantee and are not responsible for the privacy or security of such sites, such sites' compliance with applicable laws, including the accuracy, completeness, or reliability of information found on these sites. Information you provide on public or semi-public venues, including information you share on third-party social networking platforms may also be viewable by other users of the Services and/or users of those third-party platforms without limitation as to its use by us or by a third party. Our inclusion of such links does not, imply any endorsement of the content on such platforms or of their owners or operators, except as disclosed on the Services.

Our store is hosted on Shopify Inc. ("Shop" or "Shopify"). They provide us with the online e-commerce platform that allows us to sell our products and Services to you.

Shopify provides a complete commerce platform that enables merchants to unify their commerce activities. Among other features, the Shopify platform includes a range of tools for merchants to build and customize online stores, sell in multiple places (including web, mobile, social media, online marketplaces and other online locations and in person, manage products, inventory, payments, fulfillment, shipping, business operations, marketing and advertising, and engage with existing and potential customers). In these cases, Youth Crews is the Data Controller (as that term is defined by applicable data privacy statutes, our Privacy Policy will be applicable, Shopify shall act as a Data Processor (as that term is defined by applicable data privacy statutes) and the Shopify DPA shall apply to Shopify's processing of your Personal Information or Personally Identifiable Information (as those and similar terms are defined by applicable data privacy statutes, collectively "Personal Information").

You hereby consent to Shopify's Terms of Service and Shopify Data Processing Addendum (or "Shopify DPA"), and, where applicable (as set forth below and by Shopify), the Shopify Privacy Policy and/or Shopify Consumer Privacy Policy, and any other terms set forth on the Shopify site or mobile application, as amended by Shopify from time to time.

Shopify also offers other services, identified as Enhanced Services in the Shopify Terms of Services. For such Enhanced Services or as Shopify may otherwise specify, Shopify is the Data Controller and Shopify's Terms of Service, Shopify Privacy Policy, and Shopify Consumer Privacy Policy (and other policies or terms as Shopify may specify, collectively "Shopify Policies") shall solely govern its usage of your Personal Information in connection with such Enhanced Services. For these Enhanced Services, Shopify shall be solely liable for its usage of such Personal Information, its adherence to Shopify Policies and applicable laws, and we shall not be liable for the same.

11. Children's Data

The Services are not intended to be used by children, and we do not knowingly collect any Personal Information about children. You hereby represent and warrant that you will not provide any Personal Information for which you do not have all necessary consents or other legal requirements and you will not provide any Personal Information or Personally Identifiable Information in connection with anyone under the age of eighteen (18), in any case. If you are the parent or guardian of a child who has provided us with their Personal Information, you may contact us using the contact details set out below to request that it be deleted.

As of the Effective Date of this Privacy Policy, we do not have actual knowledge that we "share" or "sell" (as those terms are defined in applicable law) personal information of individuals under 16 years of age.

Please note that we may transfer, store and process your Personal Information outside the country in which you live. Your Personal Information may also be processed by staff and third party service providers and partners in these countries.

If we transfer your Personal Information out of Europe, we will rely on recognized transfer mechanisms like the European Commission's Standard Contractual Clauses, or any equivalent contracts issued by the relevant competent authority of the UK, as relevant, unless the data transfer is to a country that has been determined to provide an adequate level of protection.
